Terms of Service

Article 1 (Scope of Application)
These terms and conditions govern the use of セブ島ツアーサービス (the "Service") provided by Blue Peak Cebu (the "Company"). By using the Service, you agree to these terms and conditions.
Article 2 (Booking)
1. Tours can be booked through our website, phone, email, or other methods specified by the Company.
2. A booking is confirmed when the Company notifies you of the booking confirmation.
3. You must provide accurate information when making a booking. If false information is provided, the booking may be invalidated.
Article 3 (Fees and Payment)
1. Tour fees are as displayed at the time of booking.
2. Payment can be made by credit card, bank transfer, or other methods specified by the Company.
3. If payment is not made by the deadline, the booking may be automatically cancelled.
4. Fees may change due to exchange rate fluctuations.
Article 4 (Cancellation and Refund)
If you cancel due to your circumstances, the following cancellation fees apply:
- 48 hours or more before tour start: Free
- 24-48 hours before tour start: 50% of fee
- Less than 24 hours before tour start: 100% of fee (no refund)
If a tour cannot be conducted due to bad weather, natural disasters, or other force majeure, we will provide a full refund or reschedule. Refunds will be processed within 7-14 business days using the original payment method.
Article 5 (Tour Implementation)
1. The Company will make every effort to conduct tours safely, but tour content and schedules may change due to weather, traffic conditions, or other force majeure.
2. During tours, you must follow the guide's instructions. If you do not follow instructions, you may be excluded from the tour.
3. Some tours may not be available depending on your health condition or age.
Article 6 (Liability and Disclaimer)
The Company has a duty of reasonable care in providing the Service.
The Company is not liable for the following:
- Damage caused by force majeure such as weather, natural disasters, war, riots, strikes, etc.
- Damage caused by your intentional or negligent acts
- Damage caused by third parties
- Damage caused by your health condition or pre-existing conditions
The Company's liability is limited to the amount of fees paid by you to the Company.
Article 7 (Insurance)
The Company includes accident insurance for all tours, but we strongly recommend that you purchase travel insurance. The Company's insurance only covers accidents caused by the Company's negligence.
Article 8 (Prohibited Acts)
You must not engage in the following acts when using the Service:
- Acts that violate laws or public order and morals
- Acts that cause inconvenience to other customers or third parties
- Acts that do not follow the guide's instructions
- Dangerous acts, drunk driving, drug use
- Collection of plants and animals, acts that damage the environment
- Other acts deemed inappropriate by the Company
Article 9 (Changes to Terms)
The Company may change these terms and conditions as necessary. Changed terms take effect when posted on the Company's website. If you do not agree to the changed terms, you may request cancellation of the tour.
Article 10 (Governing Law and Jurisdiction)
These terms and conditions are governed by the laws of フィリピン法, and フィリピン共和国の裁判所 has exclusive jurisdiction.
